The agreement

These terms, together with our Privacy Policy, Cookie Policy and Shipping and Returns policy, form the whole agreement between you and Fury Mode. Nothing said in marketing material, on social media or by a member of staff varies them unless we confirm it in writing.

We may update these terms. The version that applies to your order is the version published when you placed it, and we keep it that way even if we change the page afterwards.

Using the site

You may use this site for personal, non-commercial purposes. You may not scrape it, resell its content, attempt to break its security, or use it in a way that interferes with anyone else using it.

All text, images, product photography, logos and the Fury Mode name are owned by us or licensed to us. You may share links freely; copying substantial parts of the site for your own commercial use requires our written permission.

Orders and acceptance

Placing an order is an offer to buy. The contract forms when we send you a dispatch confirmation, not when you receive an order acknowledgement.

We may decline an order, for example if the item is out of stock, if the price was listed incorrectly, if we cannot deliver to your address, or if we suspect fraud. If we decline after taking payment we refund it in full.

We sell to consumers in reasonable household quantities. Bulk and wholesale enquiries go through the contact form instead.

Prices and payment

Prices shown include applicable sales tax unless the checkout says otherwise. Shipping is calculated at checkout before you commit.

We take payment when the order is placed. If a genuine pricing error means the correct price is higher than the price you paid, we will contact you and you may confirm at the correct price or cancel for a full refund. We will not simply charge you the difference.

Delivery

Delivery estimates are estimates, not guarantees, and we are not responsible for delays caused by the carrier, customs or weather. Where we are at fault and delivery is materially late, you may cancel and receive a full refund.

Risk in the goods passes to you on delivery. Title passes when we have received payment in full.

Product information and health

Fury Mode is a food supplement, not a medicine. It contains 160mg of caffeine per can. It is not recommended for children, pregnant or breastfeeding women, or people sensitive to caffeine.

Nothing on this site is medical advice, and no statement here has been evaluated by a medicines regulator. If you have a heart condition, take medication, or are unsure whether the product suits you, speak to a doctor before drinking it.

Always read the label on the can. Where the label and this website differ, the label is correct.

Reviews and testimonials

Reviews on this site describe individual experiences and are not a promise that you will get the same result. Performance claims made by athletes we work with are their own.

If you submit a review, you grant us a non-exclusive licence to publish it. We may decline or remove reviews that are abusive, off-topic, or that we have reason to believe are not genuine.

Limitation of liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are unaffected by anything in these terms.

Subject to that, our total liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss such as lost profit or lost opportunity.

Cancellation

Consumers in the UK and EU have a statutory right to cancel most online orders within 14 days of delivery. Because our product is a consumable food item, that right does not apply to cans whose seal has been broken. Unopened cans in resalable condition can be returned under Shipping and Returns.

Governing law

These terms are governed by the law of the jurisdiction in which our business is registered, and the courts there have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the law of your own country of residence.

If any part of these terms is found unenforceable, the rest continues to apply.
